Terms of service

  1. Scope and in-store sales

These terms govern the use of foyeruniversel.ca and purchases concluded through its online store with FOYER UNIVERSEL MONTRÉAL INC., Quebec enterprise number (NEQ) 1144081701, referred to as “Foyer Universel” or “we”.

Sales concluded in our physical store are governed by separate general sales terms disclosed for those sales. The online store’s commercial conditions do not automatically extend to in-store purchases. Merely collecting an online purchase at the store does not turn it into a purchase concluded in the store.

Quotations, installation work, custom projects and business agreements are covered by separate documents when offered. An inquiry or quote request does not by itself create an order requiring payment. The classification and legal protections of each contract depend on how it is actually concluded, regardless of its title.

Nothing removes a protection or remedy that cannot legally be waived, including consumer rights under Quebec law.

  1. Products selected for online purchase

Only products expressly selected by Foyer Universel and identified as eligible for online purchase can be purchased through the online store. A product’s presence in the catalogue does not mean it is available for online checkout. Contact our team about the applicable arrangements for other products.

The specifications, dimensions, finishes, included components and technical requirements disclosed before purchase determine the product purchased. Illustrations do not limit your rights regarding conformity to the product description. Check compatibility with your project and request advice when needed.

  1. Availability and supplier stock

The online selection may include products held by Foyer Universel and products in a supplier’s stock. “In stock at the supplier” means sourcing is required, generally taking 1 to 3 weeks. This indicative timeframe, confirmed by FU for the order, is longer than for products available in our own stock; it is not by itself a guaranteed final delivery date.

Availability status and the applicable delivery date or timeframe are disclosed before purchase and repeated in the order documents. Depending on the stated fulfilment route, sourcing time is additional to handling and transit. A general “in stock”, “supplier stock” or “ready to ship” label does not replace the delivery commitment disclosed for your order.

  1. Ordering and payment

You must have the required legal capacity and use an authorized payment method. Provide accurate billing and delivery details. Before confirming, you may check the products, quantities, contacts and charges, correct errors or abandon the order.

Prices are in Canadian dollars unless clearly stated otherwise. Applicable taxes, delivery and other permitted charges, the total and payment terms are disclosed before you commit. Mandatory charges are advertised in accordance with applicable pricing rules. No unagreed paid service or surcharge is added automatically.

Contract formation follows the applicable rules. A written copy containing required information is sent within the statutory period in a format you can save and print. The terms and promotions disclosed at the time of purchase continue to govern that order.

A later catalogue correction or error in price, description or availability does not give us a general right to cancel an existing sale, impose a substitute or increase the price. We will contact you to address the situation in accordance with the contract and law.

  1. Delivery and pickup

Destinations, charges, arrangements and timeframes are specified before purchase, in accordance with the shipping and pickup policy. Service level, unloading location and access requirements for a large appliance must be agreed upon. Delivery includes installation, unpacking or removal of an old appliance only when expressly included.

We will notify you if a delay occurs. A new deadline must be agreed upon and confirmed in writing; it cannot be imposed by a simple update. Your statutory cancellation and refund rights remain applicable, including for supplier-stock products.

Wait for confirmation that the order is ready before pickup. Handing goods to a carrier does not remove our delivery obligations or your remedies for loss or damage.

  1. Returns and cancellation

The online returns, refunds and cancellation policy describes voluntary change-of-mind returns, including the 30-day period after receipt and disclosed exclusions. It applies separately from remedies for defective, damaged, incorrect, non-conforming or undelivered products.

For a return, change or cancellation request, contact infos@foyeruniversel.ca or 514 382-8222 with your order reference. Commercial return restrictions do not limit legal warranties or statutory cancellation rights.

  1. Safety and warranties

Technical sheets do not replace manufacturer instructions or assessments required for the building. Installation, connections, ventilation, clearances, permits and commissioning must meet applicable requirements and be handled by qualified professionals where required. This does not reduce our responsibility for advice or services we undertake to provide.

Legal warranties remain in effect, including normal use, reasonable durability, hidden defects and conformity to representations. Manufacturer and additional warranties supplement them; expiry does not necessarily end legal warranties. You may contact Foyer Universel to have an issue assessed.

Required information on replacement parts, repair services, documentation and any specific warranty applicable to the product must be disclosed under the rules in force.

  1. Website use and providers

Protect your account credentials, if you use an account, and report unauthorized use. Fraudulent or unlawful use, infringement of others’ rights and bypassing security are prohibited. Access restrictions justified by security do not remove obligations concerning existing orders.

Website content belongs to Foyer Universel or its rights holders. You may browse the site and use documents made available to plan or maintain a project; other exploitation requires the necessary permission unless allowed by law. External links are subject to their operators’ practices.

Shopify provides the platform; Foyer Universel is the seller. To the extent permitted by law, Shopify and its affiliates are not responsible for claims arising from transactions between you and Foyer Universel. Using Shopify or other providers does not remove our own obligations or constitute a waiver of mandatory rights.

  1. Personal information

Our privacy policy describes information handling and cookie choices. Accepting sales terms does not replace separate consent where required. Advertising use of your photos, name or project requires the appropriate permissions. Nothing here prevents you from publishing an honest review.

  1. Governing law and versions

Quebec law and applicable Canadian federal law govern these terms without excluding mandatory protections of another jurisdiction where they apply. No mandatory arbitration, exclusive court or waiver of remedies is imposed. A clause inconsistent with a mandatory rule does not reduce your rights.

The French version is made available as legally required. Another language does not replace any required steps or consents. Changes apply prospectively and do not retroactively reduce rights relating to an existing purchase. Required notices and consents must be respected.
